Q.What is a Joint Petition?

A.If a married couple has amassed a debt load they can no longer handle, the spouses (if still married) can file a joint petition. The joint petition is a single bankruptcy petition that will cover both the individual and his or her spouse. Joint petitions are not available to unmarried partners. If a joint petition is filed, both the husband and wife will be required to attend the mandatory pre-bankruptcy debt counseling and post-bankruptcy financial management education program (each spouse must receive a separate certificate evidencing attendance and completion.
