Q.Can a homeowner be held liable for personal injuries that occur in another homeowner's home, or in the common area?

A.If the homeowners association (HOA) is incorporated, an individual homeowner can never be held responsible for personal injuries that occur in another homeowner’s home, or in the common area. If the association is not incorporated, however, the individual homeowner can be held responsible if the HOA is responsible and unable to satisfy the claim, and then only if the HOA does not carry liability insurance meeting the statutory minimum requirements.
