Q.How does vacation time affect my termination policies? (CA)

A.In California, employers are not required to offer their employees paid vacation time. However, where paid vacation time is offered as a benefit, it is considered part of the employee's wages. As such, at the time of termination, or resignation, the employer must pay the employee any unused paid vacation time. Vacation time is said to "vest" at the time labor is performed on a daily basis, and must be paid to the employee on a pro-rated basis when the employment is terminated.
