Q.If the escrow officer fails to follow the escrow instructions, who can you complain to?

A.If an escrow officer fails to follow the escrow instructions, both the buyer and the seller can file a complaint with the Department of Corporations by calling: 1-800-347-6995 . If the Department of Corporations finds that a violation did in fact occur, the escrow company will be required to make a correction or issue a refund. The Department of Corporations may also issue a cease and desist letter, take possession of the escrow company, bar an individual from a position of employment with an escrow company, an even pursue civil and criminal sanctions where appropriate.

If the escrow services are being provided by a title insurance company, contact the Department of Insurance at: 800-927-4357.
