Q.What is a homestead?

A.California Code of Civil Procedure Section 704.710 defines a homestead as your personal and principal home residence. A vacation home, rental property, or second home does not qualify for homestead protection.

To qualify for homestead protection, the owner(s) of a personal residence must: (1) file a homestead declaration before a lien is attached to the property and (2) live on the property as a principal place of residence before a lien attaches to the property and continuously thereafter until the a declares the property a homestead.
