Q.Does the property I wish to declare a homestead have to be located in California?

A.No. If you live in California and your spouse lives in say Oregon, you may declare only one of the two homes as a primary home residence under the homestead exemption. If you use the homestead declaration for the Oregon property, that property should be protected by the homestead exemption.
