Q.What repairs is the landlord required to make? (CA)

A.By law, a landlord is required to provide a "habitable" (livable) residence. To ensure apartments and other rentals remain in a livable condition, California Civil Code Sections 1941 and 1942 set forth a landlords' responsibilities for repairs. Civil Code Section 1941.1 and the Health Codes require a landlord to:

  • Keep the roof, walls, windows and doors weatherproof. Unbroken doors and windows.


  • Keep plumbing, electrical and gas equipment in good working order.


  • Ensure there is a reasonable amount of hot and cold running water, and a sewage disposal system.


  • Ensure adequate and safe heating equipment (at least 4 rooms must have an adequate heat source).


  • Provide a working toilet and bathtub or shower in a room which is ventilated and allows privacy.


  • Provide a kitchen sink.


  • Keep any appliances provided by the landlord in good working order, unless the lease says otherwise.


  • Provide operable deadbolt locks on the main entry doors, and a locking or security device on each window.


  • Maintain smoke detectors in all units of multi-unit buildings, including duplexes.


  • Keep floors, stairways, railings and hallways maintained in good repair and litter free.


  • Keep fire and emergency exits leading to a street or hallway properly lit , safe and clean.


  • Keep stairs, hallways, and exits safe, properly lit, and litter-free. Storage areas, garages, and basements must be kept free of combustible materials.


  • Provide an adequate number of containers for the disposal of garbage.


  • Keep the buildings and grounds free of rubbish, garbage, rodents and other pests.
