Q.What is a Pet Trust?

A.If you leave money in your Will to a designated person to care for your pet after you have passed away, there is no guarantee the money will be used that way. Consequently, many states (16 to date) allow pet owners to set up trusts to take care of their pet after the owner has died. In California, Probate Code Section 15212 authorizes a person to create a trust for the care of a designated pet for the life of the animal. Such a trust will only exist for the life of the pet, even if the trust instrument contemplates a longer duration.
