Q.Who Should I Name as my Attorney-In Fact ("Agent")?

A.Any adult, 18 years of age or older (19 in some states), of sound mind may serve as an attorney-in-fact ("agent"). The person should be reliable, capable of performing the duties you are delegating to them, and above all trustworthy. You may wish to appoint a relative. Many people name their spouses or one or more children. If you plan to appoint two or more people to act as your attorney-in-fact consider the possibility that they may not all be available at the same time and that they may disagree and thus be incapable of performing the duties you intended. If you name multiple agents, you should also indicate whether they must act unanimously or in majority in the absence of full availability or agreement. You should also consider appointing one or two successor agents to address the possibility that your first appointed agent may be unable or unwilling to perform.
