Q.How do you Determine the gross value of an Estate?

A.In California, certain items are excluded from the calculation of a probate estate. Some of these are:

  1. Property held in joint tenancy;


  2. Property held as community property with right of survivorship;


  3. Half of all other community property;


  4. Life insurance and death benefits (assuming that beneficiaries other than the estate are named);


  5. Real property outside of California;


  6. All motor vehicles; and


  7. IRAs and 401Ks with named beneficiaries and Paid On Death accounts.
