Q.What are some of things I need to do to protect my trademark?
A.To protect and maintain your trademark, your should:
- Maintain documentation to prove when the mark was first used in commerce and interstate commerce
- Continue using the trademark properly in commerce, and/or interstate commerce always in the same manner and with the proper notice;
- Police the usage of the mark in the marketplace by others and stop any third parties from infringing the mark with a cease and deist letter and litigation if necessary; and
- File the required statements (Section 8 Affidavit) and renewals (Every 10 years) in a timely manner.
